中華人民共和國(guó)核出口管制條例

Regulations on Nuclear Export Control of People's Republic of China, 11 September 1997

第一條為了加強(qiáng)對(duì)核出口的管制，維護(hù)國(guó)家安全和社會(huì)公共利益，促進(jìn)和平利用核能的國(guó)際合作，制定本條例。

ARTICLE 1 These regulations are formulated with the aim of strengthening controls on nuclear exports, safeguarding national security and public interests, and promoting international cooperation in the peaceful use of nuclear energy.

第二條本條例所稱核出口，是指本條例附件《核出口管制清單》（以下簡(jiǎn)稱《管制清單》）所列的核材料、核設(shè)備和反應(yīng)堆用非核材料等物項(xiàng)及其相關(guān)技術(shù)的貿(mào)易性出口及對(duì)外贈(zèng)送、展覽、科技合作和援助。

ARTICLE 2 The term nuclear exports used hereinafter refers to trading, gifts to and exhibitions in foreign countries, as well as scientific and technical cooperation with and assistance to foreign countries that involve nuclear materials, nuclear equipment, non-nuclear materials used for reactors, and other items as well as their related technologies, as listed in the attachment, entitled "Nuclear Exports Control List" (hereinafter referred to as "Control List"), to these regulations.

第三條國(guó)家對(duì)核出口實(shí)行嚴(yán)格管制，嚴(yán)格履行所承擔(dān)的不擴(kuò)散核武器的國(guó)際義務(wù)。

ARTICLE 3 The State shall carry out strict management and control of nuclear exports and shall strictly fulfil its international obligations on the nonproliferation of nuclear weapons it has undertaken.

國(guó)家不主張、不鼓勵(lì)、不從事核武器擴(kuò)散，不幫助他國(guó)發(fā)展核武器。核出口僅用于和平目的并接受國(guó)際原子能機(jī)構(gòu)的保障監(jiān)督，未經(jīng)中國(guó)政府允許，接受方不得向第三國(guó)轉(zhuǎn)讓。國(guó)家禁止向未接受國(guó)際原子能機(jī)構(gòu)保障監(jiān)督的核設(shè)施提供幫助，不對(duì)其進(jìn)行核出口和進(jìn)行人員、技術(shù)交流與合作。

The State does not support, encourage, or engage in the proliferation of nuclear weapons, and does not assist other countries in the development of such weapons. Nuclear exports are limited to peaceful purposes and are subject to International Atomic Energy Agency (IAEA) safeguards. Without the Chinese Government's consent, the recipient is not allowed to make transfers to a third country. The State prohibits assistance to nuclear facilities not subject to IAEA safeguards, and does not allow nuclear expports or personnel and technological exchanges and cooperation with such facilities.

第四條核出口應(yīng)當(dāng)遵守國(guó)家有關(guān)法律、行政法規(guī)的規(guī)定，不得損害國(guó)家安全或者社會(huì)公共利益。

ARTICLE 4 Nuclear exports shall follow the provisions of the relevant State laws and administrative decrees, and shall not jeopardize national security or public interests.

第五條核出口審查、許可，應(yīng)當(dāng)遵循下列準(zhǔn)則：

ARTICLE 5 The following principles shall be observed in examining and approving nuclear exports:

（一）接受方政府保證不將中國(guó)供應(yīng)的核材料、核設(shè)備或者反應(yīng)堆用非核材料以及通過(guò)其使用而生產(chǎn)的特種可裂變材料用于任何核爆炸目的；

1. The recipient government pledges not to use for nuclear explosive purposes any China-supplied nuclear materials, nuclear equipment, or non-nuclear materials used for reactors as well as the special fissile materials produced through the use of the said materials and equipment;

（二）接受方政府保證對(duì)中國(guó)供應(yīng)的核材料以及通過(guò)其使用而生產(chǎn)的特種可裂變材料采取適當(dāng)?shù)膶?shí)物保護(hù)措施；

2. The recipient government pledges to take appropriate measures to physically protect China-supplied nuclear materials as well as the special fissile materials produced through the use of the nuclear materials;

（三）接受方政府同國(guó)際原子能機(jī)構(gòu)已經(jīng)締結(jié)生效的保障監(jiān)督協(xié)定，并承諾將中國(guó)供應(yīng)的核材料、核設(shè)備或者反應(yīng)堆用非核材料以及通過(guò)其使用而生產(chǎn)的特種可裂變材料納入保障監(jiān)督協(xié)定，接受國(guó)際原子能機(jī)構(gòu)的保障監(jiān)督；

3. The recipient government has concluded a valid safeguards agreement with the IAEA, promises to include in that agreement China-supplied nuclear materials, nuclear equipment, or non-nuclear materials used for reactors as well as special fissile materials produced through the use of the said nuclear materials and equipment, and accepts IAEA safeguards.

（四）接受方保證，未經(jīng)中國(guó)國(guó)家原子能機(jī)構(gòu)事先書面同意，不向第三方再轉(zhuǎn)讓中國(guó)所供應(yīng)的核材料、核設(shè)備或者反應(yīng)堆用非核材料及其相關(guān)技術(shù)；經(jīng)事先同意進(jìn)行再轉(zhuǎn)讓的，接受再轉(zhuǎn)讓的第三方應(yīng)當(dāng)承擔(dān)相當(dāng)于由中國(guó)直接供應(yīng)所承擔(dān)的義務(wù)。

4. The recipient government pledges that, without prior written approval by the China Atomic Energy Authority (CAEA), it will not transfer to a third party China-supplied nuclear materials, nuclear equipment or non-nuclear materials used for reactors as well as their related technologies. If prior approval is given for the transfer, the third party that accepts the transfer shall undertake commitments corresponding to those of the recipient directly supplied by China.

第六條核出口由國(guó)務(wù)院指定的單位專營(yíng)，任何其他單位或者個(gè)人不得經(jīng)營(yíng)。

ARTICLE 6 Nuclear exports shall be handled by units designated by the State Council. No other units or individuals are permitted to handle nuclear exports.

第七條出口《管制清單）所列物項(xiàng)及其相關(guān)技術(shù)，應(yīng)當(dāng)向國(guó)家原子能機(jī)構(gòu)提出申請(qǐng)，填寫核出口申請(qǐng)表并提交下列文件：

ARTICLE 7 To export items listed on the "Control List" and their related technologies, it is necessary to apply to the CAEA, fill in the nuclear export application form, and submit the following documents:

（一）申請(qǐng)人從事核出口的專營(yíng)資格證明；

1. The applicant's certificate of eligibility to handle nuclear exports;

（二）申請(qǐng)人的法定代表人、主要經(jīng)營(yíng)管理人以及經(jīng)辦人的身份證明；

2. The identification of the applicant's legal representative, the primary executives and the administrators who are entrusted with nuclear exports;

（三）合同或者協(xié)議的副本；

3. Duplicate copy of the contract or agreement;

（四）核材料或者反應(yīng)堆用非核材料分析報(bào)告單；

4. Analysis report on the nuclear materials or non-nuclear materials used for reactors;

（五）最終用戶證明；

5. Certificate of the final end-user;

（六）接受方依照本條例第五條規(guī)定提供的保證證明；

6. Certificate of pledge by the recipient as required by Article 5 of these regulations;

（七）審查機(jī)關(guān)要求提交的其他文件。

7. Any other documents requested by the examining authorities.

第八條申請(qǐng)人應(yīng)當(dāng)如實(shí)填寫核出口申請(qǐng)表。核出口申請(qǐng)表由國(guó)家原子能機(jī)構(gòu)統(tǒng)一印制。

ARTICLE 8 Applicants shall truthfully fill out the nuclear export application form. The nuclear export application form shall be centrally designed and printed by the CAEA.

第九條核出口申請(qǐng)表上填報(bào)的事項(xiàng)發(fā)生變化的，申請(qǐng)人應(yīng)當(dāng)及時(shí)提出修正，或者重新提出出口申請(qǐng)。

ARTICLE 9 If changes are to be made to the items entered in the nuclear export application form, the applicant shall promptly submit revisions, or resubmit the export application.

申請(qǐng)人中止核出口時(shí)，應(yīng)當(dāng)及時(shí)撤回核出口申請(qǐng)。

Applicants who cancel nuclear exports shall promptly withdraw their export applications.

第十條國(guó)家原子能機(jī)構(gòu)應(yīng)當(dāng)自收到核出口申請(qǐng)表及本條例第七條所列文件之日起15個(gè)工作日內(nèi)，提出審查意見，并通知申請(qǐng)人；經(jīng)審查同意的，應(yīng)當(dāng)區(qū)分情況，依照下列規(guī)定處理：

ARTICLE 10 Within 15 working days after receiving the nuclear export application form and the documents required by Article 7 of these regulations, the CAEA shall submit an appraisal and notify the applicant. If approval is given after the appraisal, the following procedures shall be followed, according to different circumstances:

（一）出口核材料的，轉(zhuǎn)送國(guó)防科學(xué)技術(shù)工業(yè)委員會(huì)復(fù)審；

1. Export of nuclear materials shall be forwarded to the Commission of Science, Technology, and Industry for National Defense (COSTIND) for review;

（二）出口核設(shè)備或者反應(yīng)堆用非核材料及其相關(guān)技術(shù)的，轉(zhuǎn)送對(duì)外貿(mào)易經(jīng)濟(jì)合作部復(fù)審或者對(duì)外貿(mào)易經(jīng)濟(jì)合作部會(huì)同國(guó)防科學(xué)技術(shù)工業(yè)委員會(huì)復(fù)審。

2. Export of nuclear equipment or non-nuclear materials used for reactors as well as their related technologies shall be forwarded to the Ministry of Foreign Trade and Economic Cooperation (MOFTEC) for review, or the Ministry shall jointly review the case with COSTIND.
